I'm Shared Owner and own a house via the Shared Ownership scheme.
Sadly not all the tenants are able to pursue Judicial Review claims due to cost factors and hence I'm appealing for funds for this.
I'm currently building a case against my housing association for negligence and breach of the lease during Staircasing that has resulted in significant losses.
Upon complaining to Housing Ombudsman I received a decision that was irrationally made with factual errors and the procedures were not followed. Even after submitting enough evidence to prove the maladministration and highlighting the flawed policy of the Housing Association appointing their own surveyor for valuations.
I'm raising money to launch Judicial Review against the Housing Ombudsman's decision and then take legal action against my Housing Association for negligence and breach of the lease.
The reason for the support is that if I'm successful then this could lead to benefiting a significant number of shared owners in the same situation who deserves compensation where their own housing association has not followed what the contract states i.e. appointment of the independent surveyor. My own housing association has breached their lease for thousands of shared owners (Cambridgeshire, Bedfordshire, and surrounding areas) of which they are completely unaware, and sadly this is still the case with the shared owners up and down the country.
The surveyors should be chosen randomly from the pool decided by both parties instead of just one party.
The housing Ombudsman feels there is no maladministration and there is enough evidence the Ombudsman was itself biased in their determination there are allegations on review websites such TrustPilot that they are corrupt and not Fit For Purpose. Despite housing owners giving enough evidence to prove their case, they are still ignored and not listened to. The appeal is also to work towards the campaign to ask govt to intervene and act on unfair/unjust determinations made by Housing Ombudsman.
The Housing Ombudsman is also under significant pressure since 2020-21 and the same is reflected in the number of service complaints received against them since that period.
I'm trying to raise the initial legal cost which could be in the region of £30-£50k.
