Please support a doctor taking a stand against discrimination
Summary - I am a doctor battling against discrimination because I was not born in the UK.
I have already taken my case to the Court of Appeal and won a judicial review in the High Court. You can access the decision here: https://www.bailii.org/ew/cases/EWHC/Admin/2021/2889.html .
I now need help to establish that the decision making which was quashed by the High Court was based on discrimination against me because of my race.
I was born in Afghanistan. I qualified as a doctor in Russia and have been registered with the GMC in the UK since 2011. The NHS Trust I worked for referred me to the GMC because, it said, my conduct was “not at the level required to practice as a doctor in the UK”. This was despite the fact that I have practised as a doctor in England since 2011!
Despite the flaws which the High Court exposed in their reasoning, the GMC, the NHS Trust and the agency which supplied me will not accept that they discriminated against me. They have each appointed their own barristers. The legal issues have become so complex in the Employment Tribunal that I now face two protracted preliminary hearings before my case can progress to a final hearing.
I have been able to keep my case going on my own so far by representing myself but I am not equipped to deal with the technical legal issues I now face. I cannot afford the expert legal fees which are needed. Please help me keep my case going and continue this battle on behalf of doctors from a minority ethnic background who work in the NHS.
