CHANGE IN FARMERS PERMITTED DEVELOPMENT RIGHTS
I'm a farmer in Herefordshire
I've applied for an agricultural barn for my farm and was turned down by Hereford Council.
When this matter was taken to court seeking fairness and justice, Mrs Justice Lang, the judge in court ruled against Farmers Permitted Development Rights, ruling that Farmers, when making a prior notification for an agricultural building (or any agricultural permitted development) have to now supply detailed evidence to JUSTIFY their agricultural need for the building
This means that a planning officer (with no farming experience could decide your barn is not necessary, as in our case)
This is a HUGE and fundamental change in the law taking away Farmers permitted development rights as laid out in Under Part 6 of The Town and Country Planning (General Permitted Development) Order 2015, where Prior notification is meant to be a light touch procedure for farmers to meet their agricultural requirements and needs. Previous to this case, farmers were only required to provide a location plan and a description of the materials to be used.
Justice Lang's judgement handed down on Monday 21st of June 2021 will Negatively alter Permitted Development rights of farmers across the UK from this date on
URGENT: We have just 21 days to apply to the court for the right to appeal this judgement on behalf of all farmers up and down the country and need £20,000 to pay for Solicitor, Barrister, Court Fees to defend this matter. Should we not raise the money this opportunity to fight for Farmers permitted development rights, will be lost forever. We have already spent > £20,000 of our own personal funds.
