On the 21st December 1988, 270 people from 21 countries were murdered in the bombing of Pan Am Flight 103 over Lockerbie, Scotland in the worst terrorist atrocity ever committed in the United Kingdom.

We believe Abdelbasset Al-Megrahi was falsely accused. He was the only man ever convicted of a crime often described as the worst miscarriage of justice in British legal history.

Libyan national Al-Megrahi was convicted on the 31^st  January 2001 of the charge of murder following trial at the Scottish High Court sitting at Kamp van Zeist in the Netherlands. Al- Megrahi was sentenced to life imprisonment with a minimum term of 27 years.

Insisting on his innocence Al-Megrahi launched his an appeal in 2007. It is alleged Al-Megrahi only dropped his appeal after being told he would not be allowed to return home from prison after he was diagnosed of terminal cancer in 2009.   

When my father returned to Libya I spent most of my time next to him and had the opportunity to talk to him as much as possible before he passed away. I am 100% certain that he was innocent and not the so called ‘Lockerbie Bomber’. He died in 2012  unable to clear his name, but until his dying breath he declared his innocence..

At first it was widely claimed that the Lockerbie bombing was  carried out by a Syrian based Palestinian terrorist group PFLP.  Investigations over the years have repeatedly suggested the switch away from the PFLP, and Syria towards Libya was effectively rubber stamped in agreement between the then British Prime Minister Margaret Thatcher and George W Bush in the White House.

It was claimed their agreement was a diplomatic insurance policy to keep Syria out of the frame because Washington believed it needed its support in the emerging tension between the US and Saddam Hussein’s Iraq.

Sending Al-Megrahi to the trial in the Netherlands meant that on the 12th September 2003, the UN agreed to pass a resolution lifting all UN sanctions imposed on Libya because of the Lockerbie bombing. 

Since 2001the reputation of the Scottish criminal justice system has suffered badly both at home and internationally because of widespread doubts about the conviction of Mr Al-Megrahi; however he was convicted in a Scottish court of law and that is the only appropriate place for his guilt or innocence to be determined.

In June 2014 we lodged an application with the Commission (SCCRC) seeking to overturn the conviction of Abdelbaset Ali Mohmed Al-Megrahi for murder. 

We have hope that on this occasion nearly 31 years after the bombing that a robust and independent Scottish legal system will deliver justice.

A reversal of the verdict would mean that the governments of the United States and the United Kingdom stand accused of having lived a monumental lie for 31 years, imprisoning a man they knew to be innocent and punishing the Libyan people for a crime which they did not commit. There must never be a time limit on justice.

The application was submitted on behalf of the immediate family members of the late Mr. Al-Megrahi along with Dr Jim Swire, Reverend John Mosey and 22 other British relatives of passengers who died on board Pan Am Flight 103 who believed there had been a miscarriage of justice.

Dr Jim Swire, who has supported the campaign for the appeal was the father of Flora Swire who, one day before her 24^th birthday, was brutally murdered along with 269 others in the Lockerbie disaster said:-

 "As the father of Flora, I still ache for her, what might have been the grandchildren she would have had, the love she always gave us and the glowing medical career? It has always been and remains my intent to see those responsible for her death brought to justice.”

WE URGENTLY REQUIRE LEGAL FUNDING

Our legal team have worked for over 6 years on this case, yet those in the Libyan Government failed to honour its promises of funding the appeal.

On the 24th November 2020 a posthumous appeal for a miscarriage of justice for the late Al-Megrahi’s will finally take place at the Scottish High Court before five senior Judges.

Many people thought that this would never happen, or hoped our legal team would simply give up trying without funding.

BACKGROUND TO CASE

2014 June - An application seeking to overturn the conviction of the late Abdelbaset Ali Mohmed al-Megrahi for murder was lodged by our legal team, over the next three years preparations begin to try and bring the case back to court.

2017- Our team first approached the Libyan authorities for funding

From 2017 to 2020 our legal team had multiple meetings and false promises of funding from officials in the state of Libya.

2020 March- We were advised the Al-Megrahi would go back to court for appeal. 

2020 July - We were informed the request for funding rested with the Chairman of the Presidential Council Al-Sarraj, Minister of Justice Mohammed Lamloun , Minister of Foreign Affairs  Mohamed Taher Siala and the Vice-President of the Presidential Council  Ahmed Maiteeq and has done since the 23rd of July 2020.

2020 11th November- Decision had been agreed by the Minister Foreign Affairs Mohamed Taher Siala and passed to the Minister for Justice Mohamed Lamloun to authorise the funding but he has still not bothered to inform anyone

It is against Libyan law for one of its citizens not to be funded in a foreign court, this would of course suit the British and American Governments. 

The Libyan Government has had no problem in spending millions on the International Criminal Courts or weapons, all whilst the Libyan people continue to suffer from the impact of sanctions and political chaos that resulted following the Lockerbie attack. 

We now urgently need funding for the costs of the appeal. Our team comprising of 5 lawyers, 2 Queen’s Counsel, advocate, legal staff, consultants and investigators have worked around the clock to prepare this appeal, which took six years of legal battles. The Appeal Court will finally  start on the 24th November 2020.

WHAT WE NEED FROM YOU

Despite promises over the course of several years  the Libyan Government has so far failed to fund the case and so we are looking to individuals to support us however much they can. 

We understand the Libyan Government does not wish to upset the UK or U.S.A. by supporting this appeal, but the case will now go ahead in a British court in Scotland.

It would be deeply shameful and insulting to Libya if the GNA’s lack of support for the appeal meant were unable to succeed in our legal campaign for justice. We need to raise £1,000,000 and pay accumulated costs.

• أنا أبن المدان الوحيد في كارثة لوكربي عام 1988 التي أودت بحياة 270 شخص حين أنفجرت بهم الطائرة وهم في طريقهم الي الولايات المتحدة. لا انا ولا أبي الراحل ولا أحد من محبي العدالة قبل الحكم ولا حتى التهمة. والدي هو المواطن الليبي عبدالباسط المقرحي الذي تحول أسمه الي مرادف للإرهاب وهو برئ منه كليا. بعد مرور عقود لازلنا نقاتل من أجل تحقيق العدالة للأبرياء ومن ضمنهم أبي. عبدالباسط المقرحي الذي توفي عام 2012 وهو يحلم بإثبات براءته.
• حوكم عبدالباسط المقرحي في محكمة أسكتلندية خاصة في هولندا وتمت ادانته في واحدة من أسوء المحاكمات في تاريخ أسكتلندا الحديث كما تبث لاحقا. مراقب الأمم المتحدة للمحكمة هنس كوشلر وصف المحكمة بأنها "إجهاض مذهل للعدالة" فيما وصفها مهندسها، خبير القانون الأسكتلندي، الدكتور روبرت بلاك بأنها "مهزلة القضاء الأسكتلندي في لوكربي". تلك المحكمة ألحقت ضررا كبيرا بسمعة القضاء الأسكتلندي محليا ودوليا وتزايدت الشكوك حول أدانة المقرحي في المقام الأول. تلكم المحكمة لم تحقق العدالة بل ساهمت في أجهاضها بحكم الإدانة الضي وصف مرارا بأنه غير مقبول او غير منطقي في أسوء الأحول.
• بدلت حكومتي الولايات المتحدة والولايات المتحدة جهودا كبيرة لمنع الأستئناف وبالتالي منع ظهور الحقيقة لأن ذلك يضعهما في مأزق أخلاقي وربما قانوني كونهما معا شاركتا في أقناع بعض أسر الضحايا بل وبعض دول العالم بكذبة تورط المقرحي على مدى 31 عاما مما ادى الي سحنه وأمركيا كما بريطانيا تعلمان أنه برئ من القضية نهائيا.
• القانون الليبي الساري يٌلزم السلطات الليبية بتحمل تكاليف القضية وقد كانت السلطات الليبية تفعل ذلك حى عام 2011 اذ يومها تخلت السلطات الجديدة عن ذلك. ولقد اوصلنا مع السلطات منذ العام 2014 مذكرين أيامها بألتزامها تجاه القضية لأنها قضية وطنية ولا تخص أي نظام سياسي ولا أي شخص بل أنها تتجاوز حتى المدان ظلما الراحل عبدالباسط المقرحي. الا ان السلطات الليبية نكتت بألتزاماتها القانونية وتركت سمعة ليبيا وسمعة الليبيين جميعا، وخاصة الراحل المقرحي، مرتبطة بمأساة لوكربي وليبيا وشعبها منها براءة.
• بداية من يوم 24 نوفمبر 2020 سيباشر فريق الدفاع، الذي يعمل متطوعا وبلا مقابل، في تقديم دفوعه القانونيه لأسقاط الحكم أو أسقاط حالأدلة التي أستند عليها وهذا أن تم سيضظهر براءة المقرحي وليبيا من أسوء كارثة جوية في تاريخ بريطانيا.
• وبالرغم من أعتقاد الكثيرين أن براءة المقرحي او أسقاط التهمة ضده أمرا مستحيلا بعض مرور كل تلك السنوات الا ان العدالة الأسكتلندية التي تضررت كثير من ذلك الحكم عليه قررت أعادة النظر فيه وهذا ما سيتظره المحكمة بداية من يوم 24 نوفمبر.
• يعتقد فريق الدفاع أن السلطات الليبية ربما تعرضت لضغوطات من حكومة المملكلة المتحدة وريما هي حريصة على عدم أغضابها وأن كان هذا على حساب ليبيا وشعبها والمقرحي وأسرته. هذة سابقة في العلاقات الدولية تجسد بوضوح أزدواج المعايير ورفض تصحيح العدالة حتى على المستوى الدولي.
• أن فريق الدفاع لا يسعى الي الربح من هذة المأساة بل أنه تطوع في المقام لأول أحقاقا للحق ولإيمانه بأن الحقيقة يجب أن تنجلي لفائدة اسر الضحايا بل والعالم بأسره . أن أيمان فريق الدفاع بالعدالة هو محركه الذي دفعه للعمل دون مقابل كلا هذة السنوات.
• أنه لمن المخزي والمهين لكل الليبيين تقاعس حكومة الوفاق الوطني عن تحمل مسئوليتها من أجل أرضاء اطرافا أخرى وبهذا تساهم في أستمرار تضليل العدالة وتغييبها.
• أننا نسعى لجمع أكبر مبلغ ممكن لتغطية بعض مصاريف فريق الدفاع وأن كان هدفنا الحقيقي هو جمع مبلغ مليون جنيه أسترليني أخدين في الأعتبار معاناة عائلة الراحل المقرحي واولاده الذين كانوا أطفالا وترعرعوا في ظل أتهام وادانة والدهم في قضية لا علاقة له بها.
• أننا نراهن على حبكم للعدالة وانحيازكم لها وعلى وقوفكم الي جانب المظلومين ونطمح في كرمكم كلا حسب مقدرته لمساعدتنا في هذة المهمة الصعبة.
• اننا نثق تماما في عدالة القضاء الأسكتلندي وأننا مستعدون علىى أكمل وجه لسماعدته الي الوصول الي نتيجة أيجابية تظهر الحقيقة وتعيد الأعتبار للراحل المقرحي وأسرته ولليبيا وشعبها.
