The Case Overview


In a distressing incident on February 28, 2020, our client became a victim of assault and false imprisonment, leading to a harrowing experience that raises serious questions about human rights and legal accountability.

She was assaulted and forcibly locked in a cage by 2 individuals 

Our client was forced to dial 999 and when officers arrived she was released. However, the way in which the Police Officers dealt with the case was appalling to say the least. Rather than investigate and gather evidence the lead officer dismissed our client’s complaints. He would later refer the incident as “handbags at dawn” and refer to our client as “hysterical”.

Following this there was not only a failure by the Officers involved to conduct an effective investigation but lies told to our client during the investigation itself in relation to the gathering of evidence.

The litany of errors did not end with the Police officers deisignated with the initial investigation the Sergeant tasked with reviewing the matter failed to consider evidential lines of enquiry and failed to provide the CPS will all relevant evidence. 

Our client was forced to pay for a private prosecution and following this her attackers were charged with Assault occasioning actual bodily harm and false imprisonment. This resulted in an eventual guilty verdict in November 2021

The handling of her case by Wiltshire Police and the Crown Prosecution Service (CPS) has been grossly inadequate, culminating in a failure to conduct an effective investigation as required under the Human Rights Act 1998 and Article 3 of the European Convention on Human Rights. Despite the evidence of failure by both the CPS and the Police both deny any liability.

The Legal Battle

Despite the obstacles faced in the initial investigation and the minimal action taken against the perpetrators, our client is determined to seek justice. This fight has led to the initiation of a claim under the Human Rights Act 1998 for a breach of Article 3 of the European Convention on Human Rights due to the failure of an effective investigation into her case. This legal challenge aims not only to seek justice for our client but also to ensure that there is accountability for the failures in the investigation process and to set a precedent that such failures by the Police and CPS are unacceptable.

Due to the nature of the case our client will not benefit from costs protection, if her case proceeds to trial and she was to lose she would be ordered to pay the legal costs of the police and CPS in a case such as this are likely to be in the region of £60,000 - £100,000.

Therefore, our client seeks funding for an after the event insurance policy. 

We are acting on a no win no fee agreement therefore, we are confident that the claim will succeed, but as with all litigation there is a risk that it would not. Therefore the insurance would cover our client in the event that the case is lost at trial.
