I'm a father who is fighting for my son with a disability against the school district that took everything away from him as far as his education and possible future.

My name is Anthony and I'm a parent who is fighting for his son with a disability. My son was diagnosed with ADHD at a very young age. His school district, District 38, and its employees knew of his condition and received countless requests from myself and his mother to stop the bullying our son had been subjected to for three years, at the hands of the students and even the principals. Instead, they expelled our son. Our lawyers know that if we can get our case in front of a jury, we have a good chance--but we've already gone through our savings and retirement, and need your help to get to court.

More About Our Son

Our son has been on a 504 and an IEP,  which the district gets government funding for, all of his school life, but the school district chose to take him off the IEP. The school's not protecting our son from bullying and not fighting for his rights caused him to get PTSD from the extreme bullying he received. Then, rather than the school district and its employees stopping the bullying, they expelled the one being bullied--our son. 

What We Have Sacrificed

Because the district expelled him, our son missed an entire year of school and missed out on the ability to socialize with students his own age for the next two years. We have been fighting the district in court since 2015 and it has cost us almost everything we have including our savings and retirement. We are several thousands of dollars into this case, Porco vs. Lewis-Palmer School District #38, and we have a long way to go. 

Why We're Fighting

By no means are my wife and I looking to get rich from this case, but we do want parents to know that schools need to be held accountable for their actions and decisions to look the other way when it comes to bullying. We also want all taxpayers to know that the money that school districts receive from the government for disability programs is not being used for those programs but for their other programs instead. We are also doing this so other children and parents don't have to go through what our family has been going through or worse. 

If we win our son will get the help he needs medically, socially, and educationally, and we hope he can go on to lead a normal life. We and our lawyers have been fighting countless motions and briefs with the 10th circuit court and Administrative Law Judges just so we can have one court to hear all of our evidence. We have a lot of evidence that shows the district's inability to know what to do with a child with a disability, or with the programs that are meant for those children with a disability. We are now waiting for the courts to hear our briefs and hopefully make a decision to go to court.

We Want Justice

My family and I and our lawyers know if we can get this to court and a jury we have a good chance to get justice for our son and hopefully prevent other families in this district and maybe around the country from having to go through what we are going through. There's more to tell about this case and the toll it has taken on me as well as my wife and family. We were hoping to get news agencies to run our case but even after interviewing us, none of the them would run our story or notify the public to see if there are other victims in this school district who would want to come forward. So this is our way of sharing our story and hopefully getting justice.
