headernavWe have now taken advice from legal counsel re the case we have to seek judicial review of the decision to award planning permission to Spirax Sarco/nav <><><>
The summary is that there are two grounds to seek review. The first is that the officers made an error in law in their treatment of the highway's impact of the application. The second concerns the lack of consideration given to the impact on a neighbouring grade 2 listed building (Langton Lodge)
This is an opportunity to bring the whole application and design back into the planning stage and to preferably reduce the size of the proposed building to a more appropriate level.
We are taking a modular approach to the process to ensure each step is appropriate and to minimize cost and risk.
At this stage there is no risk, we are seeking to fund a Pre Application Protocol (PAP) letter setting out the position to the Council and then a legal opinion on the response to that letter.
We have a target of £3,600 to produce and serve the pre-application protocol and a stretch target of £5,000 which would cover the cost of the advice leading from the responses to the PAP as well.
Time scales are tight.
The Spirax building is huge, is designed to dominate the area; apparently, to provide an impressive entrance into Cheltenham. It does that at the expense of the community that lives here.
