My name is Heather Finlay. I've long been concerned about the number of women who have been suspended by Twitter for factual tweets that supported science and biology and women’s human rights. I know this concern is widely shared by many women, and increasing numbers of men. Many have expressed their desire for legal action to assert our rights. I am now raising funds to do this.

It is deeply concerning that free speech is being restricted on Twitter. Twitter has suspended people who have simply stated facts in tweets that do not appear to have broken Twitter rules or terms of service. Examples of tweets that have resulted in permanent suspension (i.e. never allowed back) from Twitter include

‘’Yeah it did dude’’

‘’You are one very unpleasant bloke’’

‘’Only females get cervical cancer’’

‘’Male and female are biological sexes. We are talking specifically about biological sex and not gender. And I don’t know any women who are actually offended by the word ‘female’. Some men who want to be thought of as women get mad about being reminded biological sex is real''

Suspension notices typically cite 

‘’Violating our rules on Hateful Conduct: You may not promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease.’’ 

It then became obvious that not only women but also men and trans people were being suspended for supporting women and for posting similar facts.

I am raising £17750 for the initial phase of legal proceedings against Twitter. This is to take legal action against Twitter over their discrimination against me in the provision of services on the basis of the protected characteristic ‘’Religion or Belief specifically on the grounds of belief discrimination ‘’ and/or on the basis of the protected characteristic of ‘Sex’’ specifically ‘’indirect sex discrimination’’ in breach of the UK Equality Act 2010.

Who am I? – I'm Heather Finlay. I was suspended from Twitter for 24 hours for posting official government facts about male violence in the UK and have been unreasonably suspended on further occasions. I am known for advocating for both green causes and women’s rights.

Call to action – I am raising £17750 to pay for legal representation and advice for the initial phase of legal proceedings against Twitter. This covers initial legal advice plus the pre-action letter sent to Twitter, plus any followup work in regard to Twitter’s response.

We need to stand up for UK gender critical women and men on Twitter!

We need to send a message to all international social media platforms! Individuals must not be suspended for their beliefs or discriminated against on the grounds of their sex i.e. female or male. 

Social media is an important public space for social discourse and exchange of information. Lawful freedom of speech should not be curtailed.

What are we trying to achieve? 

We want Twitter to 

  • Change their policies and actions
  • Restore the Twitter accounts of those wrongly and permanently suspended. 
  • Publicly apologise for their actions 
  • Publicly acknowledge that they have discriminated against me and others
  • Review the way enforcement decisions are made based on Twitter's abuse/harassment and hateful conduct policies
  • Ensure that those expressing their protected gender-critical beliefs in a factual non-discriminatory manner are no longer wrongfully suspended.

Twitter has been restricting free speech unreasonably. They have suspended temporarily or permanently large numbers in the UK for simply expressing their belief in biology, science and women’s human rights. 

Twitter has generated a chilling factor whereby people feel that they cannot express themselves for fear of suspension..

We want gender critical women and men to be able to speak freely on Twitter.

We want Twitter to stop discriminating against its UK service users on the grounds of belief discrimination or on the grounds of indirect sex discrimination. 

What is the next step in the case? – We have done extensive initial research and taken legal advice. 

The pre-action letter was sent to Twitter on Tuesday 20th July 2021. I have launched this crowdfunder after the letter was sent so that Twitter was not alerted prior to action.

We await Twitter’s response. If our requests have not been settled satisfactorily, we will consider further legal action; including organising group litigation – often referred to as a ‘class action’ - and would start a further crowdfunder for this.

April 2022 Update

We received the reply to our pre-action letter from Twitter. After consulting our lawyers we identified several significant challenges to taking our case forward.

We continue to work on these which will take a number of steps and some time.

Additionally I am working on two other routes to achieving our objectives of holding Twitter to account. One involves political consultation with a number of MPs and committees who are involved in shaping the Online Safety Bill

The other is via a case which I have filed via the Information Commissioners office. I am arguing that Twitter makes its decisions to suspend accounts in a manner which breaks ICO rules and have filed evidence which I believe proves my case. I hope to hear from them regarding this in June 2022. I will also work with other individuals who have been sanctioned by Twitter to bring similar cases.

Twitter appoint UK Solicitor.

This is just to let you know the current state of play. Twitter have been very slow to appoint solicitors and also to reply to our letter. They eventually appointed UK Solicitors Lewis Silkin. So it looks as if the legal case will go forward. Lewis Silkin advised that they would submit an already delayed reply by 9 September but this has not been received. We are currently consulting with our solicitor  as they have failed to comply with the Practice Direction on Pre-Action Conduct .

We will be looking for potential co-Complainants for the case and will shortly advise further re this.

Speaking of Twitter, and silencing women, Heather Finlay’s crowdfunder to challenge Twitter is still a few grand short. Sorry I didn’t share it earlier, but the more I’ve thought about it, the more I like it, and I’m excited to see the possibility of a class-action suit in there too. One day, I’d like to hear Kate ‘Twitter For Good” Minshall explain under oath how exactly I “misused the platform”.
